Empire Competitions Ltd – Standard Terms

1. Legal Undertaking
1.1. By entering a Competition, the entrant will be deemed to have legal capacity to do so, you will have read and understood these terms and conditions and you will be bound by them and by any other requirements set out in any related promotional material.

1.2 Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction without regard to its conflict of laws rules.

1.3 In the event that you participate in a Competition online via the Website, and by accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

2. Qualifying Individuals
2.1 Empire Competitions (Promoters/Ours) run Prize Draw Competitions, these are skilled or knowledge-based prize competitions resulting in a person/person’s winning entry into a prize draw in accordance with these terms and conditions on our website and under the legal rules established under the Gambling Act 2005.

2.2 The Competitions are open to all persons aged 16 and over and the age of majority in their country of residence except for the Promoter’s employees or any other person who is connected with the creation or administration of our Competitions. Empire Competitions reserves the right to disqualify any entrant should we suspect you are in breach of these terms, any such disqualification will result in no refund of any entry costs paid.

3. Entering the Competition

3.1 Competitions may be entered via the Website. Multiple competitions may be operated at the same time and each Competition will have specific prizes.

3.2 When playing a Competition online via the Website, follow the on-screen instructions to choose  the Competition you wish to enter and when you are
ready to purchase your entry, complete question or skill game displayed, once complete provide your contact details and payment details.
You will need to check your details carefully and tick the declaration, confirming you have read and understood the Competition terms and
conditions and privacy policy, when your payment has cleared you will be issued with an order invoice which will be your receipt of entry, should there be a question requirement to the draw should you get the question incorrect you will not be entered into the said draw, if you answer the question correctly you will be entered into the said draw. Please note that when entering online you will not be deemed entered the draw until your order is assessed by the promoter and you have been deemed to have answered the question correctly and completed the required details as requested. Empire Competitions will make every effort to ensure any winners are contacted to claim their prize(s) however it is your responsibility to ensure your contact details are up to date and accurate as failure to respond to contact within 7 days of the prize draw may mean disqualification and no prize will be allocated.

3.3 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has
not followed these terms and conditions. Disqualified entries will not be counted but will still be charged for purchase of the competition entry.

3.4 Availability and pricing of Competitions is at the discretion of the Promoter and will be specified on the Website at time of entry.

3.5 “Your Empire Competitions account – You can register an account online. To register an account online you will be asked for relevant information.

3.6 To the extent permitted by applicable law, all Entries become our property and will not be returned, The Promoters will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website. The Promoters do not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults or any other reason.

3.7 The Entrant can enter the competitions as many times as they would like to do so, with no restriction.

3.8 Should Empire Competitions offer discount or promotion codes these shall be subject to individual terms per discount code offered. Empire Competitions reserves the right to remove any discount code offers at any time with no notice period. Should Empire Competitions deem discount codes have been shared or used outside of their intended audience we reserve the right to cancel entries, refunds of entries are at the discretion of Empire Competitions if discount codes have been misused. Empire Competitions may the chance to be entered for free via using a Partner code, this offer cannot be used in conjunction with any other discount or promotional code and any money off code will take precedent.

4. Prize Winner
4.1 The Prize Winner will be required to show proof of identification and to show the Empire Competitions entry email on delivery of the prize. Any failure to meet this obligation may result in the Winner being disqualified and the Promoter retaining the prize which may then be awarded after a new draw is made.

4.2 Following receipt and verification of the details requested above by the Promoter, the Winners will be contacted in order to make arrangements for delivery of the prize.

4.3 All Winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition. All data is kept in accordance with our Privacy Policy. The photographs and/or videos will then become property of Empire Competitions for use in marketing or promotion material. Any request to remove such material will be in breach of these prize winner acceptance terms and thus would mean forfeiture of the prize.

5. Judging the Competition

5.1 Empire Competitions may opt to use a random number generator or an unbiased judge to pick a winner from the entrants list.

5.2 There may be several winners per competition but only one winner per prize dependant on the competition.

5.3 The Promoter will attempt to contact Winner(s) using the contact information provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant’s sole
responsibility to check and update these details. If for any reason they are
incorrect, the Promoter will not be held responsible. Entrants
must carefully check their contact details have been recorded correctly.

5.4 If for any reason the Promoter is unable to contact a Winner within 10 working days (which may be extended at the sole discretion of the Promoter) of the end of
a draw winner announcement or the Winner fails to confirm acceptance of the prize or the Winner is disqualified as a result of contravening any of these terms and conditions, the Winner will forfeit the prize and the prize will remain in the procession and ownership of Empire Competitions.

6. Closing the Competition

6.1 Should any draw ran have a Minimum number of paid entries or paid value the and the minimum number is not reached as required at the closing date the Promoters reserve the right to extend the draw closing date until the minimum entries are reached or the prize fund built from the entries less costs reaches the value of the prize. Should the Promoters decide prior to the minimum number of entries being reached the Competition can be closed and the proceeds will either be deemed sufficient to award the prizes specified to the winner(s) at the discretion of the promoters, or the remaining funds will be allocated as a cash prize to the winner(s) after the deduction of any expenses and costs.

6.2 The Promoters may estimate a time frame for closure of the draw however the closing date will be once the available entries are sold. Should the Promoters deem the entries are insufficient at regular intervals during the draw the Promoters reserve the right to end the draw and distribute the funds as above into a cash prize less deductions of expenses and costs. The regular intervals and insufficient entries are deemed to be at 25% of the draw time frame (or estimated time frame on limited entry draws) less than 25% of the minimum entries to the competition not being exceeded, at 50% of the draw time frame (or estimated time frame on limited entry draws) less than 50% of the minimum entries to the competition exceeded and at 75% of the draw time frame (or estimated time frame on limited entry draws) less than 75% of the minimum entries to the competition exceeded. The estimated time frame for a draw closure will be deemed to be 1 week per 650 entries.

6.3 Should the promoter deem the draw to have failed with 10 days of the opening date the promoter reserves the right to close the draw and either refund the correct answer entrants or replace their entry with an entry or entries to draws of similar or greater value. Any paid entrant has the right to reject the new draw entries and ask for a refund on any payment made within 14 days of any new draw entries being issued.

6.4  Prize Fund – Should the draw close and the promoters issue a prize fund or the promoters be required to compare the price of the prize to the prize fund the promoters will be entitled to retain 35% of the Entry Fees as administration costs for running the draws. The remaining net balance will be produced after deductions and expenses (i.e. server charges, payment gateways, affiliate commissions and Marketing fees – these will be assumed at 50% of the remaining net entry fee), this will be the “the Prize Fund”. The Prize Fund will then be distributed to the winning Entrant(s) at a designated percentage decided by Empire Competitions based on the Prize Fund size and value of prizes being replaced by payment of the Prize Fund or be used to calculate the prize fund value against the cost of the prize should this be a term of a draw closure;

6.5 The Winner(s) agrees to allow the Promoters to display his or her name on the Website in accordance with the Privacy Policy. The name, age and town of residence of the Winner will be posted on the Website for the purposes of announcing the Winner of the Competition within 24 hours of the Winner being determined.

6.6 Entrants authorise the Promoters to enter their personal details into their database and to use the information in accordance the terms of our Privacy Policy.

6.7 The Promoters reserve the right to cancel or extend either any time frame or competition entry requirements of the Competition at any time either before or after tickets/entries have been sold. If the Competition is cancelled and no Prize Fund awarded or entries to draws of similar or greater cost, the Promoters will return the Entry Fees to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.

7. The Prizes
7.1 The Promoters make no representation or warranty as to the Valuation of the Prize, its structural or cosmetic condition or its ability to be sold. Entrants should make and rely on their own enquiries and legal advice about the Prize before entering the Competition. The prizes will be as advertised however the assumed or RRP values may fluctuate before during and after draws have taken place and as such the actual value of a prize may be different from draw commencement to draw completion and prize delivery.

7.2 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. The Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or
omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

7.3 These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any Entrant and the Promoters. An entry shall be declared void (without any refund being given) if the entrant engages in: (a) any form of fraud (actual or apparent); (b) fraudulent misrepresentation; (c) fraudulent concealment; (d) hacking or interference with the proper functioning of the website; or (e) amending, or unauthorised use of, any of the code that constitutes the Website.

7.4 Empire Competitions prizes are selected by the managing directors of the company. Details of each prize can be found on the website on the competitions pages. Empire Competitions will take no responsibility of the prize awarded after delivery, once the winner receives the prize the promoter does not insure the prize. No insurance come with the prizes and the promoter cannot be held responsible for the prize once handed over to the winner.

7.5 Delivery to the winner is free to mainland England, Scotland and Wales. The promoter has a right to charge the winner delivery fees if they want the prize delivering anywhere other than the specified areas.

7.6 All future expenses are the sole responsibility of the Winners.

7.7 Each Prize must be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of the Promoter or other prize suppliers.

7.8 At either the promoters or the winners discretion the prize may be replaced by a cash equivalent value based on the prize value estimation at the start of the competition.  Should the item no longer be available or within a reasonable time period deemed by the promoter the cash equivalent will be substituted.

  1. Spotlight Competitions

8.1 Spotlight competitions will be administered separately as minimum paid entry competitions, the minimum entry number will be displayed on the competition itself. Once the later of either the minimum number of paid entries is reached or the prize fund as detailed earlier reaches the value of the prize the draw will end on the first Sunday after the number is reached at 10pm, the winner(s) will then be picked based on the rules above governing judging the competition within 14 days of the competition end and the winner(s) announced and contacted as above.

  1. Lifestyle Competitions

9.1 Lifestyle competitions will be administered as pooled competitions which have a maximum number of paid entries per prize set at 700 and the draws will then close once the later of the minimum number of overall paid entries is reached (set at 700 total), or the prize fund as detailed earlier meets the highest prize value. The Competitions will run until 10pm every Sunday, should the conditions not be met by 10pm on Sunday the draw will roll over until these conditions are met at which point the competition will end on the first Sunday after this at 10pm. The winner(s) will then be picked based on the rules above governing judging the competition and the entry allocation they have selected will be the prize they receive subject to the further terms above and in particular section 7. The winner(s) will be drawn within 14 days of the competition end and the winner(s) announced and contacted as above.

  1. Charity Competitions

10.1 Charity competitions will be administered separately as minimum paid entry competitions , the minimum entry number will be displayed on the competition itself. The Charity competitions will be drawn at the later of when the minimum number of paid entries is met or the prize fund, as detailed earlier, reaches the value of the prize. This prize may be subject to the prize fund rules as detailed earlier in these terms if the number of entrants does not meet the earlier stated rules around minimum entries in minimum time frames, once drawn as a prize or a prize fund the winner(s) will then be picked based on the rules above governing judging the competition within 14 days of the competition end and the winner(s) announced and contacted as above.

10.2 The profits generated post costs of the competitions will then be split either after the competition end or at the end of the accounting year and 50% of said profits will then be allocated to a/multiple UK registered charity/charities either picked at the sole discretion of the promoter or selected through online voting options from a public vote on either our website or a social media platform.

11. Amendments of the Terms and Conditions
11.1 Empire Competitions reserves the right to amend, change, alter or vary any of the terms and conditions detailed above at its sole discretion.

11.2 Each competition may have its own individual additional terms and conditions. Any such terms and conditions are not binding in any way to any other competition either run at the same time or at any other time nor shall Empire Competitions be bound by any previous terms and conditions which were present in any past competitions. Empire Competitions reserves the right to amend, change, alter or vary any terms and conditions applied to any individual draw prior, during or post sale of any entries.

12. Free Draws
12.1 Empire Competitions from time to time may run and promote competitions with no cash payment required such as draws on social media with different entry requirements. Empire Competitions reserves the right to amend, alter and run these competitions in different ways to the terms above. Such Competitions may be ran, drawn, promoted and winners drawn in varying ways, further terms would be allocated to individual draws.

12.2 Empire Competitions will not be liable for any competition should the social media company remove the competition as any removal out of the control of the Promoters will invalidate any competition ran via said company or platform. The Promoters will not be liable for any issues with entries by consumers or validation of entries by the promoter due to technical or privacy settings/issues on social media platforms or any other company our free to enter competitions are held.

13. Entry Routes

13.1 Online – Entry to our competitions will be accepted online via card payment. Once your answer to the applicable question is given you will be directed to complete your First Name, Last Name, Address including post code and country, phone number and email address. You will then be asked to read and agree to our privacy policy and terms and conditions. You will then be taken to our payment provider where you will need to enter your payment card details to complete your entry. Paid entries are limited to 1 per card payment of the value of the entry.

13.2 Postal – Entry to our competitions will be accepted via post. Please post the competition name and your answer via first class post to: Empire Competitions 37 Dulverton Close, Hull, HU7 4EH followed by your First Name, Last Name, Address including post code and country, phone number and email address, please also confirm you have read and accept our Terms and Conditions as well as our Privacy Policy found at www.empirecompetitions.com. Postal Entries must be received prior to the draw  end date of the Sunday after the minimum amount of paid entries are received at 10pm. Entries via post are limited to 1 per first class letter received and 1 per person per draw.
